Kommentar
Zu den sogenannten Gräuel- oder Massenverbrechen gehören Kriegsverbrechen, ethnische Säuberungen, Verbrechen gegen die Menschlichkeit, Völkermord und das Verbrechen der Aggression (Angriffskrieg). Dies sind Verbrechen, die speziell vom Internationalen Strafgerichtshof in Den Haag verfolgt werden. Die Anschuldigung, sie begangen zu haben oder zu begehen, und ihre Anerkennung durch Parlamente und Tribunale haben eine stark skandalisierende Wirkung. Doch die Genese dieser Straftatbestände ist bizarr, ihre Abgrenzung mitunter undurchsichtig, ihre Definition klärungsbedürftig, und die Entscheidung, wer wann wofür belangt werden soll, ist nicht nur wegen ihrer politischen Dimension herausfordernd. Dies ist Grund genug für eine intensive philosophische Auseinandersetzung mit einer Vielzahl von Problemen. Der Semesterplan und einige Texte stehen vor Veranstaltungsbeginn auf Moodle bereit. So-called atrocity crimes include war crimes, ethnic cleansing, crimes against humanity, genocide, and the crime of aggression (war of aggression). These are crimes that are specifically prosecuted by the International Criminal Court in The Hague. The accusation of having committed or committing them and their recognition by parliaments and tribunals have a strong scandalizing effect. However, the genesis of these criminal offenses is bizarre, their boundaries sometimes opaque, their definition in need of clarification, and the decision as to who should be prosecuted for what and when is challenging not only because of its political dimension. This is sufficient reason for an intensive philosophical examination of a variety of problems. The semester schedule and some texts are available on Moodle before the start of the course.
